DMCA / Copyright Policy

BudFinderKC is an information directory for Kansas City-area cannabis dispensaries and clinics, operated by Wabbit LLC. This policy explains how we handle copyright complaints under the Digital Millennium Copyright Act (DMCA), and it applies to everything on the site: listing photos, menu content, reviews, and any other material a user has uploaded.

We do not scrape photos or descriptive copy from dispensary or clinic websites. The photos and text you see on a listing were either uploaded by the business that claimed it, submitted by a reviewer, or supplied by BudFinderKC itself. That matters here because it means almost everything on the site is "stored at the direction of a user" — the category of content the DMCA safe harbor actually protects.

Filing a takedown notice

If you believe material on BudFinderKC infringes your copyright, send a written notice to dmca@budfinderkc.com. To be effective under 17 U.S.C. §512(c)(3), your notice must include all six of the following:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work you claim has been infringed.
  • Identification of the material you claim is infringing, and information reasonably sufficient for us to locate it on the site (a listing URL is enough).
  • Your contact information — at minimum, an address, telephone number, or email address.
  • A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.

A notice missing one of these elements may not obligate us to act on it, so check the list before you send it.

What we do when we receive a notice

When a notice meets the requirements above, we unpublish the material rather than delete it — the underlying record stays intact so it can be restored if the counter-notice process resolves in the uploader's favor. We notify the account that uploaded the material, tell them what was removed and why, and explain how to submit a counter-notice if they believe the removal was a mistake.

We log every notice we receive: the complainant, the material identified, the date, and the outcome. That log is also how we track repeat infringement against a given account.

Counter-notice

If your content was removed and you believe it was removed by mistake or misidentification, you may submit a counter-notice to dmca@budfinderkc.com. Under 17 U.S.C. §512(g), a counter-notice must include:

  • Your physical or electronic signature.
  • Identification of the material that was removed and where it appeared before removal.
  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the U.S., any district where BudFinderKC may be found), and that you will accept service of process from the person who filed the original notice.

If the original complainant does not file a court action within 10 to 14 business days of receiving your counter-notice, we will restore the material.

Repeat infringer policy

We terminate the account of any user confirmed to have infringed copyright on repeat occasions. Confirmed infringements are counted per account, based on completed takedown notices that were not successfully countered — a single disputed or withdrawn notice does not count as a strike.

Misrepresentation

Under 17 U.S.C. §512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, can be liable for damages — including our costs and attorney's fees. Please make sure your notice or counter-notice is accurate before you send it.

This page is written for copyright under the DMCA specifically, but we handle trademark complaints and other intellectual-property concerns through the same channel. Email dmca@budfinderkc.com with a description of the concern and a link to the listing, and we will follow up.
