Advertiser and Listing Owner Terms

These Advertiser and Listing Owner Terms ("Advertiser Terms") are the contract between you — the business, clinic, or authorized agent claiming or maintaining a paid listing — and Wabbit LLC ("Wabbit," "we," "us"), the Missouri-based company that operates BudFinderKC.
They apply the moment you claim a listing, upgrade a tier, or otherwise act as a listing owner, and they sit on top of our general Terms of Service. Both apply; where the two conflict on a point specific to advertising or listing ownership, these Advertiser Terms control. If you are acting on behalf of a business, you represent that you have the authority to bind it to these terms.
Eligibility
You may claim or hold a paid listing only if you are (a) a business currently licensed by the Missouri Division of Cannabis Regulation (DCR) to operate as a dispensary or microbusiness dispensary, (b) a lawfully operating brand, manufacturer, or ancillary business serving the Missouri cannabis industry, or (c) a licensed physician, nurse practitioner, or clinic authorized to certify patients under Missouri’s medical marijuana program.
Being listed on BudFinderKC is not a determination, certification, or endorsement by us that you are licensed, compliant, or in good standing with any regulator. You are the licensee, not us — you remain solely responsible for your own compliance with Missouri cannabis law, FTC advertising law, and every other law that applies to your business, regardless of anything we publish, approve, or fail to catch.
Claiming and verification
To claim a listing you submit proof you are the business or its authorized agent, including your DHSS/DCR license number where applicable. We check that number against the state’s licensed-facility list before approving a claim, and we re-check it on a recurring basis and at every subscription renewal.
We may reject a claim, ask for more information, or revoke a claim already granted, at our discretion — including if your license lapses, is suspended or revoked, if a DCR or Attorney General action is pending against you, or if we reasonably believe your submission was false. If your license status changes, you must tell us within five days; we may unpublish your listing immediately while we sort it out.
A claim approval is not an endorsement. It means we matched your submission against the state registry at that moment — nothing more.
Tiers, placement, and labelling
BudFinderKC sells four dispensary tiers, priced and described in full on our pricing page. In short:
- Claimed ($49/mo) — direct edit access to your hours, photos, contact information, and public review responses.
- Listed ($99/mo) — everything in Claimed, plus synced menu data, active promotions, and an analytics dashboard.
- Featured ($249/mo) — everything in Listed, plus rotating top-of-page placement, additional promotion slots, and budtender staff-pick profiles.
- Premier ($499/mo) — everything in Featured, plus the #1 placement on your home city page.
Premier exclusivity
Premier’s #1 placement is exclusive: we sell one Premier slot per city page, first come, first served. Once a city’s Premier slot is sold, it is sold out — we will not sell a second business a guarantee of top placement on that same page, alternate the slot between accounts, or otherwise promise the same placement to more than one business at a time. If your city’s Premier slot is taken, we will offer you a waitlist position for that slot, or a Featured subscription instead.
If you hold one of our capped Founding Member accounts, your Founding price is honored for as long as your subscription stays active without a lapse — it does not survive a cancellation and re-subscription. Founding pricing covers the Premier feature set only; it does not include a guaranteed #1 city slot, which is allocated first-come like any other Premier purchase, including to other Founding Members.
Sponsored labelling and editorial independence
Every Featured and Premier placement is labeled "Sponsored" to consumers, in the placement itself — not in a tooltip, footnote, or hover state. You agree your placements will carry this label and that you will not ask us to remove, shrink, or obscure it.
Paid placement affects where and how prominently your listing appears. It never affects your star rating, review count, review ordering, or whether editorial content mentions you. Those are not for sale, and we will not sell them to you even if you ask.
Billing
Paid tiers bill monthly in advance to the card you keep on file, through our payment processor. Your subscription renews automatically each month unless you cancel.
We may change our prices with at least 30 days’ notice to the email on your account. Continuing your subscription after a price change takes effect means you accept the new price; cancel beforehand if you don’t.
You are responsible for any sales, use, or other tax we are required to collect on your subscription; where required, tax is added to your invoice.
If a payment fails, we will attempt to charge your card again and email you. If it isn’t resolved within a reasonable grace period, we may suspend the paid entitlements on your listing and return it to its free, unclaimed-equivalent state until your payment method is current.
You may cancel at any time. Cancellation takes effect at the end of your current billing period, and your paid entitlements continue until then. We do not provide refunds or credits for the unused portion of a billing period, whether you cancel mid-cycle or we suspend or terminate your account for a violation of these terms. Annual prepayment, where offered, is billed as a single up-front payment and follows the same no-partial-refund policy.
Content you provide and the license you grant
Everything you upload or submit through your listing — photos, logos, menu data, pricing, hours, descriptions, and anything else ("Listing Content") — stays yours. You are not giving up ownership.
By submitting it, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, resize, crop, and reformat your Listing Content, and to let our partners and any successor to this business do the same, for as long as we operate BudFinderKC or a successor service. This license is sublicensable and transferable — that matters if we ever syndicate listings to a partner site, or if the business is sold, since the license needs to travel with the listing. The resize, crop, and reformat rights are what let us build thumbnails, map cards, and social previews out of your photos without asking you every time.
You also grant us a license to display your business name, logo, and trademarks in connection with your listing and in our own marketing about BudFinderKC.
You represent and warrant that you own or have secured every right needed to grant these licenses, including from any photographer, designer, or agency who created the content. If a photo you upload turns out to belong to someone else, that is on you: you agree to defend, indemnify, and hold us harmless from any claim, demand, loss, or expense — including reasonable attorneys’ fees — arising from content you submitted or authorized, or from your breach of these representations.
If your account or listing is terminated, this license ends for content not yet published. Content already live on the site stays under license for a reasonable period after you ask us to take it down, and we may retain cached or archived copies where we are required to for legal, security, or backup purposes.
Advertising compliance attestation
Missouri regulates how cannabis is advertised (19 CSR 100-1.100(5)), and the state’s Division of Cannabis Regulation has published guidance reading that rule to prohibit any marijuana advertisement — including a website — that contains content attractive to children. In practice, package photography showing fruit, an animal, or a human figure, including cartoon or caricature versions, is treated as a violation even where the product itself is lawfully sold.
By submitting any image, deal, or piece of copy to BudFinderKC, you attest that it complies with 19 CSR 100-1.100(5) and DCR’s published online-advertising guidance: nothing attractive to children, no fruit, animal, cartoon, or human shapes on any package art, no statement that your product cures or treats a medical condition unless FDA-approved, and no price or promotional claim that DCR’s rules prohibit.
You are the approving party for every asset you submit. We do not pre-clear your content for regulatory compliance and we do not act as your compliance officer — submitting an asset is your representation that it is compliant.
We may remove any image, deal, or piece of copy at any time, without notice and without refund, if we suspect it does not comply — there is no cure period on a compliance removal. If DCR or the Missouri Attorney General ever takes action against you over something published through your listing, that cost is yours to carry, not ours; you agree to indemnify us against any claim or enforcement action arising from your advertising content.
Deals and menus
Deals and menu items must be accurate and current. Every deal needs an expiration date — we do not publish open-ended offers.
If your synced menu data goes stale, we may suppress the affected items rather than show a customer a price or potency figure that no longer matches what is on the shelf. That is not a penalty; it is what keeps the listing useful to the person reading it.
Cannabis may never be offered as a contest, sweepstakes, or giveaway prize on BudFinderKC — Missouri’s licensed distribution system does not allow product to leave a dispensary except as a tracked sale or disbursement, and we will not publish an offer that implies otherwise. Non-cannabis prizes, such as gift cards or merchandise, are fine.
Reviews and responses
You may respond publicly to reviews of your business, and you may flag a review you believe violates our Community Guidelines for our staff to look at. You may not solicit reviews in exchange for a discount, free product, or any other incentive, and you may not ask us — or pay us — to remove or bury a review because it is negative.
Flagging is for policy violations, not for reviews you simply don’t like. Every removal we make is logged with a reason, and "a business didn’t like it" is not one of the reasons we act on.
Data
We do not share the contact information you gave us to claim your listing with anyone else. Consumer data — who is browsing, who is reviewing, who is clicking through to your listing — belongs to BudFinderKC. We may share aggregate, de-identified metrics with you about your own listing’s performance, but we do not hand your customers’ personal information to you or to any other advertiser.
Term and termination
These terms last as long as you hold a claimed or paid listing. You can end them by canceling your subscription — see Billing above.
We can suspend or terminate your listing, claim, or account at any time for a violation of these terms, a lapse in your Missouri licensure, a DCR or Attorney General enforcement action tied to your business, or nonpayment. In serious cases, we do not owe you advance notice.
The license grant, the compliance attestation, the indemnity obligations, and anything else that by its nature should outlive termination, survives it.
Disclaimers and limitation of liability
BudFinderKC is provided as-is. We do not guarantee any particular amount of traffic, leads, or business from your listing, and we make no warranty about the platform’s uptime, the accuracy of third-party data, or fitness for a particular purpose.
To the extent the law allows, our total liability to you for anything arising from these terms or your listing is capped at the amount you paid us in the three months before the claim arose, and we are not liable for indirect, incidental, or consequential damages, including lost profits.
Governing law
These terms are governed by Missouri law, without regard to conflict-of-law rules. Any dispute goes to the state or federal courts sitting in Jackson County, Missouri, and you consent to that venue.
Changes
We may update these terms as our product or the law changes. We will post the new effective date at the top of this page, and where a change materially affects your obligations or pricing, we will also email you at least 30 days before it takes effect. Continuing to hold a paid listing after that date means you accept the change.
